Information Commission issues notice to SPIO for not furnishing info

The State Information Commission Haryana has served a notice on State Information Public Office (SPIO) of Development and Panchayat, Haryana for allegedly not furnishing the sought information under the Right to Information (RTI) Act to a RTI activist. The Commission also directed the SPIO to file his written reply to the points raised by the complaint in its complaint.

Subhash, coordinator of Haryana Suchna Adhikar Manch, had sought information from the Development and Panchayat department regarding a government order in which Sarpanches were appointed as the Public Information Officer (PIO) but the department did not supply him the required information even after six months of the demand. He had submitted the application with requisite fees to Public Information Officer, Chief Secretary Haryana, RTI cell, on September 24 last year.

“I wish to know that can any public representative be appointed as Public Information Officer (PIO), if yes, then under which rules Sarpanches of village panchayats across the state have been appointed as PIOs ? If Sarpanches can do the work of the PIOs then why Chairman of Zila Parishad and MLAs are not the PIO of their area concerned? Can any illiterate person become the PIO as so many sarpanches are illiterate in the state?,” informed Subhash, adding that he waited for the reply for nearly three months but nothing came from the authorities concerned.

Then, he had to file first appeal against the SPIO of the Development and Panchayat department on December 6, 2010 demanding an official action against him but the First Appellate Authorities also did not took it seriously, said the coordinator.

“Later, I knocked at the door of the State Information Commission which taking my second appeal seriously issued a notice under section 18(2) of the Right to Information Act, 2005 to the SPIO of the Development and Panchayat, Haryana, for not supplying me the sought information,” said Subhash, adding that the SPIO had also been directed to appear before the commission on August 4 next for presenting his comments in this regard.
