Three senior officials summoned for not furnishing info

The State Information Commission Haryana has summoned three senior officials of Haryana Government, including the SPIO (State Public Information Officer)-cum-Superintendent, General Administration Department Haryana, the SPIO-cum-Under Secretary to Govt. Haryana, Personal Department, Haryana and First Appellate Authority cum Special Secretary, Personal Department, for allegedly not providing entire sought information to a Right to information (RTI) activist. The commission has also directed them to appear before its bench on May 18 next when the appeal will be taken up for hearing.
Subhash, the RTI activist and state coordinator of Haryana Suchna Adhikar Manch, informed that he had filed an application with requisite fees on May 20, 2010 before the office of Chief Secretary Haryana to get the information under the RTI act regarding those IAS, IPS, IRS, HCS and HPS cadre officers who have been re-employed in various departments of the state government during the past 10 years,
“I wanted to know that how many IAS, IPS, IRS, HCS and HPS cadre officers have retired in the state during the time span of January 2000 to March 2010. The additional queries also include how many among them have been reemployed, is there any norm prescribed for providing reemployment to administrative officers after their superannuation and how many new posts have been created to adjust the officers?,” said Subhash, adding that taking action on the application, the chief secretary office directed the SPIO-cum-deputy secretary (DS), Personnel Department, Haryana, for making the sought information available to the applicant under Section 6 (3) of the RTI Act.
The Personnel Department on June 22 had furnished him a list of 86 IAS and 41 HCS officers who got superannuation during the past 10 years, but did not provide any input about their re-employment saying that it had not further information in this regard except this, he maintained.
“Thereafter, I made an appeal before the first appellate officer (FAO) and asked for getting the information from the department concerned, besides initiating appropriate official action against the SPIO-cum-deputy secretary of the Personnel Department. Then the FAO directed the finance commissioner-cum-principal secretary to the Finance Department, Haryana, for furnishing me the information,” said Subhash.
He maintained that the finance commissioner on August 19 wrote again to the SPIO of the Home and Personnel Department for making available the information to the applicant as the information was concerned with their departments, but to no avail.
“Ultimately, I had to move an application before the State Information Commission which taking action on my appeal has now issued notices to the three officials of Haryana government under section 19 (3) of the RTI act for not providing me the entire sought information,” said Subash, adding that the commission had also warned the officials that the appeal would be heard and decided on merits in case they or their representatives failed to appear on the fixed date.
